These Terms & Conditions (“Terms”) govern your use of Apna Awaas, operated by
EZ Codes (“we”, “us”). They apply to the Android and iOS apps (bundle ID
com.ezcodes.nivaas), the resident web app, and this website. By creating an account or using
the product you agree to these Terms and to the Privacy Policy.
If you do not agree, do not create an account and uninstall the app. You may delete or redact an existing account at any time, free of charge.
1. The service
Apna Awaas is a housing-society operations tool. It helps residents and committees manage visitors, maintenance dues, expenses, complaints, family members, and security duty. Features depend on the role your society assigns (for example head, society admin, staff, or member). We may add, change, or withdraw features with reasonable notice when the change is material.
2. Eligibility and accounts
- You must be at least 16 years old, or the age of digital consent in your country if higher.
- One person uses one account. The login identifier is a mobile number; keep the number and password confidential.
- You are responsible for activity on your account and for telling us if you lose control of the number or a device.
- We may refuse, suspend, or close an account that is inaccurate, abusive, or a security risk.
3. Societies, roles, and your content
A society on Apna Awaas is a workspace. The person who creates it is its head. Head authority is not transferred automatically. Invitations, house links, visitor logs, dues, expenses, and complaints belong to that society’s operations.
You grant us a limited licence to host, display, and back up content you submit solely to run the service for your society. You represent that you have the right to submit that content (including visitor details and payment proofs).
Do not upload unlawful material, malware, or content that infringes others’ rights. Do not attempt to access another society’s data, probe the API beyond your role, or interfere with geofence or attendance checks.
4. Payments
Apna Awaas records maintenance dues and payment proofs. We are not a bank, escrow, or card acquirer. Money moves between residents and the society outside the app (UPI, cash, transfer, and similar). Upload only genuine proofs. Disputes about amounts are between you and your society.
5. Location and device permissions
Security duty may request precise location to confirm a guard is on site. Camera and files are used for photos and proofs you choose to attach. You can deny a permission in the OS settings; the related feature will not work. Background location is not used for advertising or movement tracking.
6. Acceptable use
You agree not to:
- impersonate another resident, guard, or committee member;
- share login credentials or scrape personal data of other users;
- use the visitor or complaint tools to harass anyone;
- reverse engineer the apps except where the law allows;
- overload or disrupt our servers.
7. Privacy, GDPR, and deletion
How we process personal data, including GDPR legal bases and your rights of access, rectification, erasure, restriction, portability, and objection, is described in the Privacy Policy. Store listings must link to that policy.
Google Play and Apple require account deletion for apps that create accounts. You can request deletion in the app (Profile → Delete account) or on the Delete or redact account page after a one-time code sent to the email on the account. We complete a verified request within 30 days, subject to the last-head and legal-hold limits in the Privacy Policy. Deletion is free and does not require a paid subscription.
8. Availability and changes
We aim for reasonable uptime but do not warrant uninterrupted service. Maintenance, hosting issues, or force majeure may cause downtime. We may update these Terms; the effective date on this page is the current version. If a change is material, we will post it here before it applies.
9. Intellectual property
Apna Awaas, the name, logos, and software are owned by EZ Codes or its licensors. You receive a personal, non-exclusive, revocable licence to use the apps and website for your society. You do not receive any other IP rights.
10. Third-party stores and services
Download from Google Play or the Apple App Store is also governed by that store’s terms. In-app purchases are not currently offered. Hosting, email, and optional SMS providers process data as described in the Privacy Policy.
11. Disclaimer and liability
The service is provided “as is” for operational coordination. We do not guarantee that visitor screening, GPS duty, or payment records will prevent incidents, fraud, or unpaid dues. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential loss, or for loss of data that you can recover from your own records. Nothing in these Terms limits liability that cannot be limited (including for death, personal injury caused by negligence, or fraud).
If you are a consumer in the EEA/UK, you keep mandatory statutory rights. Our liability for services under a consumer contract is not excluded beyond what those laws allow.
12. Termination
You may stop using Apna Awaas and delete your account as above. We may suspend or terminate access if you breach these Terms, if the society workspace is closed, or if we discontinue the product with notice. Sections that by nature should survive (IP, liability, governing law) survive termination.
13. Governing law
These Terms are governed by the laws of India, without prejudice to mandatory consumer protections in your country of residence (including GDPR where it applies). Courts at New Delhi, India have jurisdiction, except where consumer law gives you the right to sue in your home courts.
